The Federal Land Problem

Montana hosts two of America's most iconic national parks. Cannabis possession on any federal land is a federal misdemeanor regardless of Montana state law. This is the most critical consumption rule for visitors. Montana's biggest attractions — Glacier National Park, Yellowstone National Park, Flathead National Forest, Gallatin National Forest, and millions of acres of BLM land — are all federal jurisdiction. Cannabis must be consumed and left behind before entering any federal land.

Public Consumption: $50 Fine

Consuming cannabis in any public place carries a fine of up to $50 plus forfeiture of the cannabis. "Public place" includes:

  • Streets, sidewalks, and parking lots
  • City and county parks
  • Hiking trails and trailhead parking areas
  • Campgrounds (state and private)
  • Rivers and float launch sites
  • Ski areas and resort common areas
  • Any place open to public view

While $50 is a modest fine, the forfeiture component means you lose whatever cannabis you have with you. More importantly, consuming on federal land elevates this to a federal misdemeanor.

Transporting Cannabis

When transporting cannabis in your vehicle:

  • Keep it in sealed original packaging from the dispensary
  • Store in the trunk or glove box — not on seats or in the open
  • Treat it like an open container of alcohol
  • Do not consume in a moving vehicle, even as a passenger

Tips for Visitors

  • Book cannabis-friendly lodging: Some vacation rentals and cabins explicitly permit cannabis use. Always confirm directly with the host before booking.
  • Consume before outdoor adventures: If your plans include national parks, forests, or BLM land, use cannabis at your private lodging before heading out. Do not bring any with you.
  • Float trips: Montana's famous float culture (Clark Fork, Blackfoot, Missouri rivers) takes place on public waterways. Cannabis consumption while floating is public consumption.
  • Ski towns: Whitefish, Big Sky, and other resort areas have dispensaries, but consuming in ski lodges, on slopes, or in resort common areas is not permitted.
