Can Tourists Buy Cannabis in Montana?

Yes. Montana law treats visitors exactly the same as residents when it comes to cannabis purchases. All you need is a valid government-issued photo ID proving you are 21 or older. There is no residency requirement. Montana's 13.8 million annual visitors are a major market segment, with gateway town dispensaries built specifically to serve tourists.

The Two Critical Rules for Montana Visitors

Rule #1: No Cannabis on Federal Land

Montana hosts Glacier National Park and Yellowstone National Park — both federal land where cannabis is a federal misdemeanor. This also applies to national forests (Flathead, Gallatin, Lewis & Clark, Lolo, and others), BLM land, and wildlife refuges. Rule #2: Montana Borders Zero Legal States

Idaho, Wyoming, North Dakota, and South Dakota all prohibit recreational cannabis. Crossing any state line with cannabis is a federal crime and will also violate the destination state's laws. Do not transport cannabis out of Montana under any circumstances.

Where You Can Consume

Private property only. Montana has no consumption lounges and no on-site consumption at dispensaries. Your legal options:

  1. Cannabis-friendly lodging — some vacation rentals and cabins explicitly permit cannabis use. Always confirm directly with the host.
  2. Private residence — if staying with friends or family who permit it

Where You Cannot Consume

  • Streets, sidewalks, and parks ($50 fine)
  • Hotels and resorts (most prohibit it)
  • Dispensary parking lots or premises
  • Moving vehicles (driver or passenger)
  • All federal land (national parks, forests, BLM)
  • Rivers and float launch sites (public waterways)
  • Ski slopes and resort common areas

Critical Visitor Rules

No Cannabis in National Parks

Glacier and Yellowstone are federal land. Cannabis possession is a federal misdemeanor — up to 1 year in prison, $1,000 fine.

No Flying with Cannabis

TSA operates under federal law at all Montana airports. Do not bring cannabis through security at MSO (Missoula), BZN (Bozeman), FCA (Kalispell), BIL (Billings), or HLN (Helena).

Do Not Drive Impaired

Montana has a strict 5 ng/mL per se THC limit. Zero tolerance for drivers under 21. Wait at least 4–6 hours after smoking. Sealed packaging in the trunk.

No Crossing State Lines

All neighboring states prohibit recreational cannabis. Idaho, Wyoming, North Dakota, South Dakota. Do not take cannabis across any border.

The Green/Red County System

Montana's 56 counties are split into 28 green (recreational sales allowed) and 28 red (no recreational sales). All major tourist destinations are in green counties, but be aware that some cities have additional restrictions. Billings (Montana's largest city) banned adult-use dispensaries.
