Federal Land = Federal Law
Montana is home to two of America's most visited national parks, and both are entirely under federal jurisdiction. Despite Montana's legal cannabis market, possessing any amount of cannabis on federal land is a federal misdemeanor under the Controlled Substances Act. Montana state law has absolutely no effect within park boundaries.
Cannabis remains a Schedule I controlled substance under the federal Controlled Substances Act (21 U.S.C. 812). Possession on federal land is a federal misdemeanor carrying up to 1 year imprisonment and a $1,000 fine.
National Park Service Law Enforcement
Glacier National Park
Glacier National Park encompasses over 1 million acres of pristine wilderness in northwest Montana. Cannabis is illegal everywhere within the park, including:
- All roads, including Going-to-the-Sun Road
- All campgrounds and picnic areas
- All trailheads and hiking trails
- All visitor centers and developed areas
- All backcountry campsites
- Glacier Park Lodge and other park lodging
- All parking lots within park boundaries
Gateway dispensaries: Whitefish (15 dispensaries), Columbia Falls (13). Purchase and consume at your lodging before entering the park. Leave all cannabis products behind.
Yellowstone National Park
Yellowstone National Park spans over 2.2 million acres across Montana, Wyoming, and Idaho. The entire park is federal land, and cannabis is illegal regardless of which state entrance you use. This includes:
- All roads, loops, and scenic drives
- All campgrounds (Mammoth, Madison, Grant Village, etc.)
- All geyser basins, including Old Faithful area
- All visitor centers and ranger stations
- All lodges (Old Faithful Inn, Lake Hotel, etc.)
- Lamar Valley, Hayden Valley, and all wildlife viewing areas
- All backcountry and wilderness areas
Montana gateway dispensaries: West Yellowstone (4 dispensaries), Gardiner (2), Big Sky (8), Bozeman (numerous). Purchase and consume at your lodging before entering the park.
Other Federal Land in Montana
The national parks are the most visible, but Montana has vast federal landholdings where the same rules apply:
National Forests
- Flathead National Forest — surrounds Glacier, 2.4 million acres
- Gallatin National Forest — Bozeman to Yellowstone corridor
- Lewis and Clark National Forest — central Montana
- Lolo National Forest — Missoula area
- Helena-Lewis and Clark National Forest
- Bitterroot National Forest
- Beaverhead-Deerlodge National Forest
- Kootenai National Forest
- Custer Gallatin National Forest
BLM Land
The Bureau of Land Management administers over 8 million acres in Montana. BLM land is federal land, and cannabis possession is a federal offense. Much of eastern Montana's rangeland and some popular recreation areas near rivers are BLM-managed.
Wildlife Refuges
Montana has numerous National Wildlife Refuges managed by the U.S. Fish and Wildlife Service, all federal jurisdiction.
Military Installations
Malmstrom Air Force Base (Great Falls) and any other military installations are federal property where cannabis is strictly prohibited.
What Happens If You Are Caught
Cannabis possession on federal land is typically handled as a federal misdemeanor (Class B, 36 CFR 2.35):
- Fine: Up to $1,000
- Imprisonment: Up to 1 year
- Typical outcome: Citation, fine, and confiscation. Park rangers have discretion, but the violation is real and on your record as a federal offense.
Medical cannabis cards provide no protection on federal land. The federal government does not recognize state medical cannabis programs.
Practical Advice for Park Visitors
- Buy cannabis in a gateway town — Whitefish, Columbia Falls, Big Sky, West Yellowstone, Gardiner, Bozeman, or Missoula
- Consume at your private lodging before heading to the park
- Leave all cannabis products at your lodging or in a secure location outside the park
- Do not store cannabis in your vehicle when driving through the park — a vehicle search could discover it
- After the park — return to your lodging to consume. Buy more at a dispensary if needed.
Enjoy Montana's legal cannabis market at your private lodging. Enjoy Glacier and Yellowstone cannabis-free. Do not try to combine the two. The parks are worth experiencing fully present anyway.
